One of the most confusing aspects of Australian immigration is the De Facto Australian Visa. This kind of visa applies to relationships that are unmarried with an Australian resident, Australian citizen or eligible New Zealand citizen. There are certain factors that need to be considered before using this as the means of entry into Australia. This is but a reflection of changing social values which result in an increase of unmarried couples that bear fruit but face the problem of immigrating to the country.
These de facto Australia visas are applied for and have the term of two years which provide the individual the privilege to apply for permanent residency. Since this kind of visa is prone to abuse and fraud, there are many parameters that have been set forth for these kinds of visas. These are the conditions that need to be present in order to qualify for this kind of special visa.
· The applicant must be in a “genuine, continuous de facto relationship” with the sponsoring partner and this relationship must be at least 12 months in length.
· The relationship with the sponsor must be exclusive and genuine.
· The two parties must be able to prove they have lived together/are living together, although they may have to live separately on a temporary basis while the application for a De Facto Australia Visa is considered.
· The applicant must be able to produce evidence that the relationship has been ongoing for 12 months, is genuine and not a short-term arrangement.
Aside from the above provided guideline, the following are also requirements that need be complied with by the applicant:
· Undergo a medical examination, which will include a chest x-ray, by a doctor chosen from a panel put together by the Austrian authorities.
· The applicant must also be able to provide certificated proof that they have no criminal record in any country in which they have stayed for more than 12 months, over the last 10 years.
· Other evidence and proof as may be required during the process of application
The application process for de facto Australian visas usually take between three to six months but if there are problems that arise, the application length may be extended. All the evidence and proof presented would be investigated and verified and once suspicious circumstances are found, or there is a lack of evidence or other mitigating factor, then the application would outrightly be rejected by the Australian immigration authorities.
The two year timespan upon receipt of the approved visa and the option to apply for permanent residence provides ample time to make sure the relationship is real and without any shady circumstances. This also is the time for authorities to root out fraudulent visa applications through the guidelines currently in place.
If you have the proper documentation and evidence to support such relationship, then going through the process would have no hitch and would pass quickly. Just ensure that all your paperwork and proofs are genuine and bona fide and you will find out that there are very few hindrances along the way to Australia.
